Sir Neil McKay CB, Chair of the Joint Committee of Primary Care Trusts, said:
“We have today lodged the application to appeal the recent ruling by the High Court in response to the claim for Judicial Review by the Royal Brompton Hospital. We are pleased that the Judge rejected all but one of the grounds on which the Royal Brompton based their claim. However, it is disappointing that the Judge quashed the consultation on a point that he conceded had no material bearing on the JCPCT’s choice of consultation options. It is for this reason that members of the JCPCT unanimously agreed to appeal the court’s decision at a meeting on 17 November. A hearing date for the appeal is expected to be in early 2012. The case for change has never been stronger and we remain committed to reaching a decision on the future of children’s congenital heart services next year.”
